Our client and the complainant were in an intimate relationship for approximately 4 months. After the relationship ended, the complainant alleged that the client had sexually assaulted her. Tonii Roulston identified significant credibility issues in the complainant’s statement, including a clear motive to fabricate the allegation. Tonii also raised Charter issues arising from the police’s receipt of text messages from the complainant in violation of the client’s section 8 rights. Tonii negotiated with the Crown, and the matter was resolved by way of a peace bond. As a result, the charges were withdrawn and the client was not convicted and avoided a criminal record.
