R v B.M. [Calgary Provincial Court]

Impaired Driving and Assault Police Officer: Charges withdrawn Alternative Measures

The client was charged with impaired driving, refusal to give a breath sample and assault of a police officer. Tonii Roulston reviewed the file and set the matter for trial prepared to argue that the client’s Charter rights were violated during the police investigation. Before the trial date, the Crown Prosecutor agreed to withdrawn the charges at the completion of the alternative measures program (AMP). The client completed AMP for a simple assault charge and all other charges were withdrawn. The client has no conviction, no license suspension and no criminal record.
