R. v. D.F. Provincial Court of Alberta (Calgary)

D.F. was charged with dangerous driving.  After a police vehicle chase the vehicle went into the parking lot at a McDonalds.  D.F. was arrested in the bathroom at McDonalds.  At trial the issue was whether the Crown could prove that D.F. was driving the vehicle. 

Result:  After a 2 day trial and lengthy oral and written argument, the Honourable Judge R.B. Camp found D.F. not guilty, stating the Crown had failed to prove the identity of the driver of the vehicle beyond a reasonable doubt.
