R. v. J.C [Calgary Provincial Court]

The client was charged with one count of failing to provide a sample of his breath contrary to section 254(5) of the Criminal Code. Prior to trial Robin McIntyre filed written Charter arguments with the crown and court alleging that the police breached the Client’s section 8 Charter right to be free from unreasonable search and seizure. The matter proceeded to trial.

Successful result: The Client was found ‘Not Guilty’ at trial, did not receive a criminal record, and was able to have his license returned.
