R. v. J.M. Provincial Court of Alberta (Calgary)

Client charged with 9 counts of aggravated sexual assault in relation to non-disclosure of HIV status.  2 counts of aggravated sexual assault were alleged to have occurred when client was on judicial interim release pending trial.   Ms. Urquhart argued the frailties of the Crown’s case as one of the reasons why J.M. should be entitled to bail. 

Result: After a lengthy bail hearing the Court ordered J.M. released on a no cash bail with restrictive conditions.
