R v J.T.H. [Calgary Provincial Court]

The client was charged with a refusal to provide a breath sample contrary to s 254(5).

Successful Result: The charges were reduced to obstruction of justice under s 129, and the client obtained a Conditional Discharge on a one year probationary period.
