R v K.C.

The client was charge with possession of a prohibited weapon and possession of a weapon for a dangerous purpose contrary to s 88(1) and 86(1) of the Criminal Code when it was alleged he used a spring loaded baton in a brawl. Prior to trial Defence counsel made written argument that the police had breached the clients s 10(b) Charter right to counsel when he was not provided with the opportunity to contact counsel. 

Successful result: Charges were withdrawn.
