R v R.S. [Calgary Provincial Court]

Assault Police Officer: Charges Withdraw Alternative Measures

The client was charged with assault of a police officer after allegedly striking and spitting on a police officer. Tonii Roulston negotiated with the Crown Prosecutor to reduce the offence to an assault simple due to the fact that the arresting officer’s used excessive force in arresting the client. The Crown Prosecutor agreed to have the charge reduced to assault, contrary to s. 266 of the Criminal Code and eventually withdrew the charge at the completion of alternative measures. The client has no conviction and no criminal record.
