R. v. R.W. et al. Court of Queen’s Bench (Calgary)
Client charged with being in possession of $120,000.00 worth of oxycontin which was located underneath the drivers seat of his vehicle. At trial Ms. Urquhart argued that her client’s rights under s 8 & 9 of the Charter (to be free from arbitrary detention and unlawful search and seizure) were violated.
Result: The Honourable Justice S.L. Hunt McDonald found that R.W.’s rights were breached. The Crown directed a stay of proceedings.
