A 16 year old male pled guilty to sexually assaulting an intoxicated 12 year old girl

A 16 year old male pled guilty to sexually assaulting an intoxicated 12 year old girl in a schoolyard. Staff of the school witnessed the assault and one videotaped the girl who appeared extremely intoxicated. Defence lawyer Tonii Roulston said that the guilty plea was only because the girl was extremely drunk and, thus could not legally consent to sexual activity.

 

Assessment Reports for 16 year old accused of sexual assault

A young offender charged with sexually assaulting a 12 year old pled guilty to the assault charge and additional charges stemming from breach of his release conditions. A court exhibit of agreed facts submitted by Crown counsel and defence lawyer Tonii Roulston said that the 12 year old girl was heavily impaired and could not remember the otherwise consensual sexual activities. A pre-disposition, psychiatric, and risk assessment report were ordered for the 16 year old accused.

 

Youth sexual assault charge adjourned 

Tonii Roulston, acting as counsel for a youth charged with sexually assaulting a 12 year old in front of witnesses sought an adjournment for the proceedings based on the large amount of disclosure anticipated. Staff turned over video evidence and eight people appeared to have witnesses the assault. Judge Burell questioned the adjournment but was advised by Roulston that is was necessary in light of the disclosure.
