Our client was charged with two counts of sexual assault against the complainant. The complainant was having an extra-marital affair with our client. The charges stemmed from an evening where the client and complainant had two sexual encounters. During that same evening, the complainant saw the client with his ex-girlfriend, causing a fight to ensue. Tonii negotiated with the Crown highlighting credibility issues with the complainant including a motive to fabricate due to the complainant’s affair and text messages that suggested consent. As a result, the client avoided a criminal record and a conviction.
