R v CR

Kirsten Lancee defended CR against multiple serious allegations, including flight from police, dangerous
driving, assaulting a police officer, and possession of five loaded, restricted guns inside his vehicle. The
client had a significant criminal record including for firearms and driving offences. Kirsten wrote a s. 12
Charter Notice, alleging that her client’s right to be free from cruel and unusual punishment had been
violated, as the police had shot her client in the course of his arrest. The Crown’s initial resolution
position was 6 years’ imprisonment; after rigorous negotiations, including responding to the Charter
Notice, the Crown ultimately agreed to join the Defence’s sentencing proposal of a 24-month jail
sentence.
