Our client was charged with two counts of sexual assault. Our client and the complainant were in a relationship at the time of the alleged offence. Tonii Roulston applied for a s.276 application to introduce prior sexual history between the client and the complainant into evidence. Through this application, Tonii highlighted the inconsistencies with the complainant’s statement and established a defence of honest but mistaken belief in consent. Tonii was able to reach a resolution through further negotiations resulting in a peace bond for the client. The client avoided a criminal record and a conviction.
