Our client was charged with sexual assault and failure to comply with a condition of release. The complainant was our client’s ex-girlfriend. After they broke up, the complainant claimed our client sexually assaulted her during their relationship. Tonii was able to get a withdrawal on the failure to comply with a condition charge and a peace bond for the sexual assault charge. She demonstrated that the complainant had a motive to fabricate due to a breakdown in their relationship and that both parties were recovering from substance abuse. Our client was attending rehab, counselling, and taking positive steps toward recovery. Tonii was able to highlight this progress and the client’s remorse to the Crown, leading to no conviction or criminal record for the client.
