R v JY

Kirsten Lancee defended JY against multiple child pornography offences, including making and
distributing child pornography. Kirsten reviewed the primary investigating officer’s affidavit (ITO) which
supported the issuance of a search warrant and noted discrepancies between the surveillance and the
grounds stated in the affidavit. In advance of trial, Kirsten filed a Garifoli Charter notice alleging that the
search warrant would never have been granted had the issuing justice been given the full and correct
information. After reviewing the Charter notice, the Crown agreed to offer JW a s. 810.1 peace bond. The
charges were withdrawn and JW has no criminal record as a result.
