The client was charged with possession and accessing child pornography contrary to sections 163.1(4.1) and 163.1(4) of the Criminal Code. After reviewing the disclosure, Tonii Roulston entered into negotiations with the Crown. Tonii identified significant issues with the Crown’s ability to prove the essential elements of the offences, as well as a potential Charter violation under section 8. As a result of these negotiations, the matter was resolved by way of a peace bond, the charges withdrawn, with no convictions and no criminal record.
