Kirsten Lancee defended AW at two different trials, where he was accused of possessing a significant
amount of fentanyl, methamphetamine, crack cocaine and cocaine for the purpose of trafficking. In
advance of each of the trials, Kirsten filed a Charter Notice, alleging that the police had violated her
client’s rights to be free from warrantless search and seizure, to be free from arbitrary arrest, and to afford
her client his right to counsel without delay. The Crown entered a stay of proceedings on one file in
January 2024 after determining the evidence would not be admissible due to Charter breaches. After
hearing from the primary officer in the second trial, the Crown agreed that there were again significant
Charter issues and asked the Court to dismiss the charges. All charges against AW were stayed or
dismissed as a result.
