R v AD

Kirsten Lancee defended AD against allegations of possessing fentanyl for the purpose of trafficking and
possessing methamphetamine for the purpose of trafficking, in addition to several counts of breaching her
release order and possessing stolen property. In advance of trial, Kirsten filed a Charter notice, alleging
that AD’s right to be free from warrantless search and seizure, to be free from arbitrary detention or arrest,
and to be advised of her right to speak to with legal counsel without delay were violated when police
began questioning her. The Calgary Court of Justice agreed and ordered that the evidence obtained from
AD be excluded at trial. AD was acquitted as a result.
