R v CF

Kirsten Lancee defended CF against allegations of sexual assault causing bodily harm, forcible
confinement and assault. Kirsten wrote a “Jordan” application on behalf of CF, arguing that his right to be
tried within a reasonable time, in violation of s. 11(b) of the Charter, had been seriously violated. The
Lethbridge Court of Justice agreed and ordered that CF’s charges be stayed without requiring a trial. CF
has no criminal record as a result. The Blood Tribe Police sergeant assigned to the case also received
disciplinary action.
